Sub: Request to take legal action against the Aliens Developers – Reg.
I, submit that I have got agreement of Sale of Flat No. 601 in Station #1 in Aliens Space Station – 1, situated at Village - Tellapur,Mandal – Ramchandrapuram, Medak - District in the Year – 2009 for sale consideration of amount of Rs.37,03,425/- out of which I’ve taken loan from State Bank Of India, PBB Abids Circle branch(Home Loan A/C No.30878114755 and saving A/C no. through which EMI was paid – 20020305090), for an amount of Rs. 24,34,000/- and partially disbursed an amount of Rs. 11,11,028/- to the builder as agreed, and also paid an amount of Rs. 7,40,685/- total an amount of Rs. 18,51,713/- to them remaining amount will be paid at the time of handover of the flat by December – 2012 considering 6 months of grace period. On verification by personally visiting the Aliens Space Station – 1, I found only one station was constructed structurally, and another one is under construction since long time.
Further it is submit that I and other customers who bought flats are also facing the same problems with the builders. Aliens Group. Managed by 1) Hari Challa, 2) Venkat Prasanna Challa and 3) C.V.R Choudary are neither constructing, or handing over the constructed flats and asking extra money than agreed as per agreement of sale, I also came to know that a single flat is being sold to multiple customers and earning out of it.
I also came to know that few owners has been threatened to cancel their flats if they speak about Aliens fraud, cheating in public.
It is also observed that there is no construction for the said station and for other stations as well. They failed to handover the constructed apartments in spite of collecting total agreed sale consideration and they made sale of same apartment to multiple owners by defrauding.

Subject –Either hand over of our flat no. 601 in station#1 and flat no.420 in station#4 in Aliens Space Station#1,Tellapur, Hyderabad or Refund of principal amount with 24% interest which works out to be Rs.7751423/ (As mentioned in AOS). – Reg.

I and my son have booked flat no.601 in station#1 Vide A9/SS/959 dated 23/06/2009 and flat no.420 in station#4 Vide A9/SS/918 dated 23/05/2009 in Aliens space station#1,Tellapur, Hyderabad in 2009 and paid Rs.1851713/- and Rs.1587500/- respectively through State Bank Of India, Hyderabad bank home loan A/C No.30878114755 & Saving bank A/C No.20020305090 and State Bank of India, Hyderabad bank loan A/C No.31038291213 & Saving bank A/C No.20031656309 respectively in the year of 2009, which is a 50% cost of flat, with a commitment by Aliens to hand over flats in Three years as per “Agreement of Sale” i.e. in the year 2012.But Aliens could not deliver the flats till now. In fact Aliens did very little work and seems most of our fund was diverted in their other project.

Therefore M/S Aliens is noticed and intimated either to refund our principal amount with 24% interest from the date of our payment to Aliens as per AOS signed by M/S Aliens (which works out to be Rs.42,58,923/-+Rs.34,92,500/- = Rs.7751423/-) or hand over alternate ready flat available at other station#14 at the same rate with delay compensation as agreed in AOS to us at the earliest otherwise action as deemed fit will be initiated against M/S Aliens Developers Private Limited.

We have paid entire loan amount to State bank of India.

We will return AOS to M/S Aliens after getting entire principal amount with interest in our saving bank account which is mentioned above or after getting hand over of alternate ready flat available at other station#14 with delay compensation as agreed in AOS.

Sub. – Sanctioning of House Building loan by SBI official of Hyderabad without checking of genuiness of Builder’s Paper to favour Builder –Reg.

I and my son were sanctioned house building loan in 2009 by SBI official without inspecting builder’s (Aliens Developers Private Limited, Hyderabad) valid document by SBI and paid money to builder without progress as well as without registration of property (Which is the very primary checks of Bank) resulting loss of our Principal amount (Rs.1851713/- + Rs.1587500/- = Rs.3439213/-) along with interest since 2009 which works out to be Rs.2407210/- + Rs.1905000/-=Rs.4312210/- at the rate of 24% as per AOS and Total amount works out to be Rs.7751423/- for these five years as builder did not make our apartment(intention was to cheat customer) till now and is not going to make before 2022 as orally intimated by M/S Aliens executives and that time also M/S Aliens will hand over flats with increased rate as being threatened by M/S Aliens.

I have purchased flat in June 2010 on promise of handover in 2011, till now construction took place surprisingly and AG sold my flat to another customer for almost double price. When I approached, they are not repaying my money. Filed cheating case in PS Madhapur and FIR lodged. AG is adopting unfair trade practice.
This people are cheaters, they robbed hundreds and thousands by showing glossy presentations and promising delivery of flats as per agreed date. Finally ending up robbing the money and not even delivering the flat. I bought a flat in Alien Space Station in year 2012 and they promised to deliver the flat by Dec 2013 with a grace period of 6 months. They took an advance of 34 lakhs on a condition that the balance will be paid at the time of handover of flat. Its almost 2 years 6 months now and there is no progress. Still the station in which I booked a flat is at ground level. When questioned regarding the progress and the handover, they end up ignoring or giving sarcastic replies. And when we demanded shifting in flats which are already constructed, they demanded extra money violating the contract. Finally when we requested for cancellation, they are not doing repayment nor handing over the flat.
Totally fraud.

2. When bank is involved in approving project and when customer believe in credibility and go with project then make bank also responsible for delay. Banks at this moment don't take any responsibility if project gets delayed. Banks don't give EMI holiday period if construction gets delayed/stalled. And in this phase bank mandates customer to pay EMI. And interest paid by customer is no where compensated. This is pure loss to customer. Builder/Banker needs to be made responsible. Banks approving project and gave sense of confidence to customer for going ahead with project, banks need to pressurize builder to complete project on time and it should black list the builder for further projects if project completion track is completely gets deviated.

4. Respective builder should be penalized for any delay in construction and handover with occupancy certificate, irrespective of whatever the reasons mentioned as per agreement.
The cost of appreciation caused by the delay of construction, with minimum of 18%, should be proportionately paid to the apartment purchaser every month from the date of delay caused, considering no grace period

5. if any project gets delayed by many years, have controlling steps to make project get handed over to other builder or government to take control and execute.

6. Have separate re-addressal cell for real estate issues. Builders don't fear for law, law takes it time and again customer is in loss. Time elapsed makes customer to stick to current project and wait for completion, customer loses opportunity and time which is very crucial.

7. Never allow builder to handover flats to customers till builder get no objection certificate. Electricity and water supply to be provided by government only when builder satisfies all formalities of government. As of now builder gets power and water supply from back door and do not complete project and makes flats delivered at convenience.

8. Ensure builder never demands additional money after agreement of sale. Once price negotiated and concluded in agreement of sale both parties to stick it. Labour/resource price increase should not be matter for customer, it is builder's responsibility to complete project on time else it is very evident that prices will keep shooting up and customer cannot be responsible to bear this loss.

1. Flats not to be sold on super built up area, but only on carpet area.

2. Flats not to be sold before all building plans and construction plans have been approved. Builder to give an undertaking that the plans have been completely sanctioned and all building plans and approvals to be placed online.

3. No change in layout, area material of construction to be allowed without the written consent of at least 60% flat buyers.

4. For any delay in construction penalty of 18% to be paid by builder to the buyer on a monthly basis from the date of delay.

5. In case of cancellation of flat by buyer due to a delay in handing over he should be paid within 90 days the entire amount.

6. Money for each project shall be put in a dedicated bank account solely for the project so that fund diversion does not happen.

7. No flat of an existing owner can be used by the builder for his site office without an written agreement by the flat owner. The flat owner is entitled to get rent at the market rates for such use.

8. Any dispute between owner and buyer to be settled within 6 months through consumer courts or any other separate legal mechanism.

9. No selling of cancelled flat by the builder until all dues of the previous owner has been paid.

We have paid entire loan amount (Principal and Interest) to State Bank of India and got back our original AOS being a government officer and good citizen of India.
Hence I request you to please look into the matter and do the needful to get our apartment or principal amount with interest. I had taken home loan from SBI considering it Government of India and I am also government officer invested my whole life hard earned money.

I have purchased flat in June 2010 on promise of handover in 2011, till now construction took place surprisingly and AG sold my flat to another customer for almost double price. When I approached, they are not repaying my money. Filed cheating case in PS Madhapur and FIR lodged. AG is adopting unfair trade practice.
This people are cheaters, they robbed hundreds and thousands by showing glossy presentations and promising delivery of flats as per agreed date. Finally ending up robbing the money and not even delivering the flat. I bought a flat in Alien Space Station in year 2012 and they promised to deliver the flat by Dec 2013 with a grace period of 6 months. They took an advance of 34 lakhs on a condition that the balance will be paid at the time of handover of flat. Its almost 2 years 6 months now and there is no progress. Still the station in which I booked a flat is at ground level. When questioned regarding the progress and the handover, they end up ignoring or giving sarcastic replies. And when we demanded shifting in flats which are already constructed, they demanded extra money violating the contract. Finally when we requested for cancellation, they are not doing repayment nor handing over the flat.
Totally fraud.

2. When bank is involved in approving project and when customer believe in credibility and go with project then make bank also responsible for delay. Banks at this moment don't take any responsibility if project gets delayed. Banks don't give EMI holiday period if construction gets delayed/stalled. And in this phase bank mandates customer to pay EMI. And interest paid by customer is no where compensated. This is pure loss to customer. Builder/Banker needs to be made responsible. Banks approving project and gave sense of confidence to customer for going ahead with project, banks need to pressurize builder to complete project on time and it should black list the builder for further projects if project completion track is completely gets deviated.

4. Respective builder should be penalized for any delay in construction and handover with occupancy certificate, irrespective of whatever the reasons mentioned as per agreement.
The cost of appreciation caused by the delay of construction, with minimum of 18%, should be proportionately paid to the apartment purchaser every month from the date of delay caused, considering no grace period

5. if any project gets delayed by many years, have controlling steps to make project get handed over to other builder or government to take control and execute.

6. Have separate re-addressal cell for real estate issues. Builders don't fear for law, law takes it time and again customer is in loss. Time elapsed makes customer to stick to current project and wait for completion, customer loses opportunity and time which is very crucial.

7. Never allow builder to handover flats to customers till builder get no objection certificate. Electricity and water supply to be provided by government only when builder satisfies all formalities of government. As of now builder gets power and water supply from back door and do not complete project and makes flats delivered at convenience.

8. Ensure builder never demands additional money after agreement of sale. Once price negotiated and concluded in agreement of sale both parties to stick it. Labour/resource price increase should not be matter for customer, it is builder's responsibility to complete project on time else it is very evident that prices will keep shooting up and customer cannot be responsible to bear this loss.

1. Flats not to be sold on super built up area, but only on carpet area.

2. Flats not to be sold before all building plans and construction plans have been approved. Builder to give an undertaking that the plans have been completely sanctioned and all building plans and approvals to be placed online.

3. No change in layout, area material of construction to be allowed without the written consent of at least 60% flat buyers.

4. For any delay in construction penalty of 18% to be paid by builder to the buyer on a monthly basis from the date of delay.

5. In case of cancellation of flat by buyer due to a delay in handing over he should be paid within 90 days the entire amount.

6. Money for each project shall be put in a dedicated bank account solely for the project so that fund diversion does not happen.

7. No flat of an existing owner can be used by the builder for his site office without an written agreement by the flat owner. The flat owner is entitled to get rent at the market rates for such use.

8. Any dispute between owner and buyer to be settled within 6 months through consumer courts or any other separate legal mechanism.

9. No selling of cancelled flat by the builder until all dues of the previous owner has been paid.
